Rinkor Rare Coins, LLC (“the Company,”) is a privately held business formed in 1993 under the laws of the state of California. Because we are not affiliated with the United States Government, or any government agency, we can assure your privacy in all transactions.

The Company is always prepared to assist you in selecting coins for your portfolio or collection. You understand, however, that the decision to purchase coins, and which coins to purchase, is ultimately yours alone. You acknowledge and agree that your relationship with the Company is that of retailer-customer at arm’s length, and is not a fiduciary relationship.

You may return any numismatic coins you order from us, in their original holders, within 14 days of receipt for a full refund, unless you are otherwise notified at the time of the sale. Carefully inspect and evaluate your coins during this period. To receive a refund or exchange, you must return your numismatic coin order to the Company, registered and insured via the U.S. Postal Service, in the original holder as shipped, within 14 days of receipt. Shipping fees are non-refundable. We do not reimburse return postage fees unless the return is due to an error on our part. If PayPal is used for payment of your coins, the fees will be deducted from your refund. We guarantee your full satisfaction. Coins removed from original holders are considered SOLD and non-returnable.

Coins we categorize as “Bullion” are not subject to return or exchange. Sales of all such Bullion coins shall be final. Shipment of Bullion orders is normally accomplished within 10 days of funding unless the client is advised otherwise of unusual market conditions in effect at the time of the sale.

All coins are guaranteed genuine. Grades and descriptions of rare coins are opinions, not statements of fact or guarantees, and are based on standards and interpretations that can and do change over time. Rinkor Rare Coins, LLC uses contemporary grading standards and interpretations to grade coins and relies upon the opinions or independent grading services such as the Professional Coin Grading Service, the Numismatic Guaranty Corp., and ANACS. Each of these grading services is recognized by the coin industry for its expertise. Each firm guarantees the grade and certifies each coin to be authentic. The Company relies upon those guarantees in selling coins. However, we do not guarantee that the coins we sell will achieve the same grade from any independent grading service in the future and express disclaim any other warranties with respect to the coins, expressed or implied, including the implied warranties of merchant ability and fitness for a particular purpose. All items are subject to prior sale and may have limited availability.

All investments involve risk. Numismatic coins and bullion are no exception. The coin market is volatile and thinly capitalized and therefore subject to substantial fluctuations including significant and rapid increases and decreases in value from time to time. Investors must be able to assume the risk of such price fluctuations. For that reason, rare coins are not a suitable investment for everyone. The Company does not represent that any customer buying for investment purposes will be able to sell for a profit in the future and recommends that investments in numismatic coins or bullion should only be part of a diversified portfolio. You should consult with your independent financial advisor before disposing of any security, annuity, Certificate of Deposit or other investment to acquire rare coins, currency or bullion.

Payment is due immediately upon receipt of this Invoice unless otherwise agreed in writing by the Company. Title to items sold does not pass until the Company is fully paid in good funds, although risk of loss or damage passes to you upon delivery of coins ordered from the Company. In the event you fail to make payment when due, the Company reserves the right to pursue collection of the sale price, rescind the sale or to resell the items. You agree to pay for all costs associated with collection, reselling the items or rescinding the sale, including any attorney costs, collection fees and interest, and any shortfall from reselling which will become immediately due to the Company from you. Should any sums due hereunder not be paid by you within 30 days of demand from the Company, interest on the amounts due shall accrue at the rate of 1.5% per month, compounded monthly, until the Company is paid in full (unless this rate exceeds the maximum permissible by law, in which case any amount paid in excess to the legal limit will be applied to the principal).You grant the Company a security interest in any items you purchase from the Company and the proceeds thereof, as well as in any property of yours in the Company's possession, to secure any indebtedness of yours to the Company, and agree that the Company shall have all the rights of a secured creditor under the Uniform Commercial Code with respect to same.

At present, there are no restrictions or regulations on the sale, purchase, or ownership of rare coins. However, there is no guarantee that, in the future, governmental and/or other institutions will not impose such restrictions or regulations. The Company will add 9.75% sales tax to purchases by California residents under $2000. The Company does not collect use tax which may or may not apply to purchases by non-California residents, which is a matter between you and your state taxing authorities.

If you wish to sell your coins in the future, the Company encourages you to offer them to us first. We cannot guarantee to make a bid on every coin or that our bid will equal or exceed that from other coin dealers, but we are very strong buyers of DMPL Dollars, Peace Dollars, Seated Dollars, Trade Dollars and other high-grade coins. We also would be very willing to assist you in selling your quality coins as your agent on consignment, on mutually-agreed terms.

All prices are subject to change with respect to current market pricing. Every effort is made to keep pricing on this site up to date; however, changes to current market prices may not be reflected if there has been a recent and significant increase. In the event there is a price increase on your order, you will be notified and given the option of accepting the price change, dropping the item from your order, or canceling your order altogether. Also, we are not perfect, and we do make mistakes from time to time. As such, we reserve the right to refuse to sell any item that is improperly priced or whose price is the result of a web page or programming error.

Information and statistics used in the preparation of the Company’s advertising materials, letters, and oral presentations are derived from industry sources that we believe to be reliable. Any statements or predictions by our staff are opinions only, not statements of fact. Remember that market conditions are subject to change without notice and no guarantee of accuracy is either expressed or implied.

Any controversy or claim arising out of or relating to transactions between you and the Company, including whether such claims are arbitrable, shall be settled by arbitration through the Professional Numismatists Guild (PNG) or, if PNG cannot or will not accept the matter, by a single arbitrator in accordance with the Commercial Arbitration Rules of the American Arbitration Association conducted in Sonoma County, California. You hereby irrevocably waive any right you may have to join claims with those of others in the form of a class action or similar procedural device. Any claims arising out of, relating to, or connected with this agreement must be asserted individually. The Arbitrator shall award the prevailing party its attorney’s fees and costs for the arbitration. Judgment upon the award rendered by the Arbitrator may be entered in any court having jurisdiction thereof.

No claim may be filed by a customer in connection with a particular transaction more than one year after the transaction occurred regardless of when the customer became aware of the claim. This agreement is performable in and subject to the internal laws of the State of California, without reference to choice of law rules. With respect to any coin transaction, the Company’s liability shall be limited to a refund/replacement of the coin and shall in no event exceed the original purchase price of the coin, and the Company disclaims liability for direct, incidental, consequential, special, exemplary or other indirect damages, even if the Company has been advised of the possibility of such damages.

All coins purchased by personal or business check will require a 7 to 10 day waiting period to allow the check to clear. Cashier’s checks and money orders will be shipped within 3-5 business days. All credit card purchases will be shipped within 48 hours of approval. In addition, all coins purchased by credit card will only be shipped to the billing address for that card. If the credit card used does not meet a qualified standard, you may be subject to the additional credit card fees over the 4% we are normally charged. Bullion items may be purchased with a credit card, however the buyer will pay a 4% surcharge.

All coins will be shipped through FedEx or USPS and insured for the full retail price on the invoice. In the event of a lost package, we will make a claim, where appropriate, and you agree that recovery under said insurance shall be your only remedy against the Company. We are not responsible for consequential or other damages that might occur.

These terms and conditions constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede any oral or written statement made by the Company or any agent of the Company prior to any transaction. No waiver by the Company of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

These Terms of Sale do not and are not intended to confer any rights or remedies upon any person other than you.

If any provision of these Terms of Sale is declared or found to be unlawful, unenforceable or void, such provision will be ineffective only to the extent that it is found unlawful, unenforceable or void and the remainder of the provision and all other provisions shall remain fully enforceable.
